Caltrain comes through and cleans up site in the Bayview...again

Two months ago, my friend Tony "The Green Goatee" joined me in getting onto Caltrain's case about a problem that I'd been calling them about for the past two years (at 1-800-660-4287).  The obvious safety problem was being exacerbated by a hole in Caltrain's fence at the Oakdale Overhead that gave access to anyone to the tracks below.  It was an obvious safety hazard, with the hole at sidewalk level big enough for a child or pet to easily slip through.  Homeless people used this hole to access the area below and use it as their own.  Their trash had built up to disgusting levels inside the fence on Caltrain's property, graffiti was awful and was making its way onto the historic tunnel opening, and bags of human waste were beginning to show up on the street level above the tracks. 

I'm happy to report that Caltrain came through this week, whether because of Tony's involvement in writing the right person, or because it had finally come up on their schedule of repairs to do something.  The hole is repaired, some of the trash is cleaned up, most of the graffiti is gone, but the smell of human waste remains.  Even with limited funds, and despite it taking two years of complaining, I still feel like Caltrain has become more responsive to our community's requests for maintenance on their property.  The trash-dumping site on Quint Ave below their tracks was cleaned up earlier this year after repeated complaints, and homeless encampments along Caltrain's tracks near the Produce Market were also cleaned up with a coordinated effort from SFPD.

Frustrated with the amount of time it often takes to get things like this repaired or cleaned up, a group of us at the Quesada Gardens Initiative have been working with Caltrain for the past two years to try to gain access to the part of their property at street level, closest to Palou Ave and Dunshee St, so that we could get in there and clean it up ourselves.  We have insurance, signed agreements, and have agreed to make upgrades to Caltrain's own fence between the upper lot to the tracks below.  The lot used to be a dumping site, with decaying cars and trash littering both sides of the fence.   Today, thanks to work we've already put into cleaning things up, dumping is down easily by 95%, and neighbors are getting a chance to meet and know one another instead of being afraid to go near the place.

It's a testament to how things often work.  If you want to make something worse, just go ahead, rip a hole in a fence, and do whatever you like - you're unlikely to get caught, and it'll take years before anything happens to make it better again.  However, if you want to make something better, you have to figure out who the right people are to talk to, get everything in writing, get permission, and then follow a set of tight restrictions on what you can do, because heaven forbid you do something that would be unattractive.

We're looking forward to continued involvement with Caltrain at this site.  Quesada Gardens Initiative has created a first of its kind agreement with the agency to gain access to their property for community use.  Perhaps other groups out there can use our model and do the same!  In two weeks, QGI will be partnering with neighbors and other local groups for a first-time cleanup of the main part of the property that it's taken us years to legally gain access to.  We're very excited, and I'll obviously be posting more information about it here.  We'd love it if you could spend a few hours with us, October 15, 10AM-1PM, at the corner of Dunshee St and Palou Ave.

BAYVIEW OFFICERS ARREST THREE SUSPECTS LAST NIGHT WITH LOADED FIREARMS AT 3RD AND WILLIAMS. One suspect has previous firearm conviction. Details below.

Bayview Station holds community meetings with the Captain on the first Tuesday of each month. We are working on holding these monthly meetings at various locations within the Bayview to help provide access and convenience to all residents who wish to attend.

Incidents of Interest:

On September 29th at 9:12 PM, Officers responded to a “shot spotter” activation in the area of 3rd and Revere. The “shot spotter system is a group of receiver dishes secured strategically around the district. They pick up the sound of gunshots and accurately pinpoint their location of origin. This information is then broadcasted to units in the area.

Officers arriving at 3rd and Revere immediately located a 22 year old male victim, laying in the street with gunshot wounds to his buttocks and legs. He was conscious and was able to speak to the Officers while they rendered medical assistance until the paramedics came on scene. He was transported to SFGH where he is expected to recover.

Officers found that the shooting occurred on the 1500 block of Revere and secured both scenes as well as all evidence and witness statements. This incident is being investigated by the Gang Task Force. (SFPD Case No. 110786994)

On September 25th at 4:30 AM, Officers patrolling the area of Bayshore and Marin saw a vehicle drifting from its lane marker and then veering back into the lane. The vehicle swerved and suddenly crossed three lanes of traffic abruptly. The Officers pulled the car over and contacted the driver who had red watery eyes and slurred speech. He told that Officers that he did not drink, yet he had a very strong odor of an alcoholic beverage emanating from his breath.
They performed field sobriety tests on the subject, who failed them all, and placed him under arrest. A breath test was conducted with the subject’s breath alcohol level being captured at .101%, well above the legal limit of .08%. He was booked at Bayview station for driving while under the influence of alcohol. (SFPD Case No. 110772432)

Bayview Police Weekend Re-Cap

On September 23rd at 12:25 PM, a resident was inside his home with his wife on the 500 blockof Missouri. The front door was propped open as the day was warm and they wanted air circulation. Suddenly, from their living room, they looked up to see a shirtless subject reaching across the threshold of the front door to grab a computer attaché case that was near the entrance. The suspect snatched it and took off running with the victim in pursuit. His wife called the police who also responded.

The victim chased the suspect on Missouri all the way to Sierra St. At that point the suspect slowed and the victim ordered him to drop the bag. The suspect dropped it and continued on as the victim picked up the bag, all computer and accessory items intact, and began for home.

Meanwhile, Officers were looking for the suspect and saw a subject that matched the broadcasted description, still shirtless, walking in the area of 22nd and Pennsylvania. They conducted a cold show with the victim who positively identified him as the intruder who stole his computer and who he chased down. The suspect was placed under arrest and booked at Bayview Station. An investigation into his possible involvement in the similar hot prowl burglaries in the area is ongoing. On Thursday, consumer advocate and former Presidential candidate Ralph Nader called the U.S. Postal Service's financial problems a manufactured crisis, and called on Congress to take quick, easy action to prevent further service cuts, Post Office closings, and job cuts.

In a letter to Senator Joseph Lieberman and Congressman Darrell Issa, Mr. Nader proposed simple solutions to fix the U.S. Postal Service's financial hole. Mr. Nader noted, however, that the financial "crisis" facing the USPS was completely manufactured.

It appears this will conflict with another mayor's debate at SFSU the same night, but David Chiu, Bevan Dufty, Leland Yee, and Joanna Rees are apparently coming so far.

Bayview homeowners blame liquor store for crime

Sometimes, publicly calling on city officials who've been slow to take action is the only way to get things done, but where's the public meeting? Where are the demonstrations? Where are the community and city leaders, taking to the streets, to denounce and rebuke the shooting and to rally the community to say that enough is enough?

While Dennis Herrera never responded to residents' complaints, I'm pleased to say that Rebecca Prozan and Yvonne Mere of the City Attorney's office are now on the case and working with residents to clean this corner up. It's not just the market that's the problem, but it certainly is the center of much of the negative activity. Mendell Plaza, across the street, is also a hang-out with drug dealing and public drinking going on. Getting some focus on cleaning up Torino and that empty ramshackle building at Mendell and Oakdale will go a long way to making this, which happens to be where my own MUNI stop is located, safer.

The Port of San Francisco coordinating with the SF Municipal Transportation Agency and the Copra Crane Labor Landmark Association (CCLLA) (a group of active and retired laborers, historians and other stakeholders) have started the initial phase to restore the Copra Crane as an eventual landmark to labor.

The condition of the crane’s pile supported substructure has required the removal of the crane so that the pile supported structure could be repaired. The Crane will be completely removed within the next week and is underway. The Port will them work with the CCLLA on the repair of the crane and platform so that the crane can be put back into place.

On September 20th between 4:30 AM and 5:00 AM, a burglary attempt was made at a business on the 5900 block of 3rd St., The owner and Officers responded to an alarm activation. The skylight at the premise had been broken, however nothing inside appeared to be disturbed. No suspects were found on the roof or inside the building. The owner informed Officers that the skylight was the same method of entry used a month prior in a burglary there in which multiple items were taken. (SFPD Case No. 110756759)

On September 20th between 9:30 AM and 7:30 PM, an apartment on the 500 block of Wisconsin was burglarized. The resident returned home to find that his front door and door jamb had been damaged and that a computer, watch, and camera were stolen from the residence. Crime Scene Investigation responded to collect evidence. This incident is under investigation. (SFPD Case No. 110761548)

On September 21st at 4:45 AM, Officers responded to a call of an alarm at a business on the 1500 block of Burke. They located two broken windows and made entry into the building where they found a tire iron that was presumably used by the suspect to break the glass. The owner was notified and responded. He stated that a laptop had been stolen from the premise. The Officers searched the area for a suspect but were unable to locate him/her that morning. This incident is under investigation. Although this meeting isn't taking place in D10, access to good, clean food, water, and green spaces are things that are important to all of us, and so I thought the meeting might appeal to people in the Southeast part of the city, too.

America’s Worst 9 Urban Food Deserts

As I posted last month, parts of the Bayview and Visitacion Valley are in a Federally recognized food desert, where it's easier to get a McDonald's hamburger and a bottle of Colt45 than it is an apple or salad ingredients.

Thankfully, with the addition of our new Fresh & Easy store at 5800 Third St., that is changing.

“Food desert” is a term commonly used to describe communities with little or no access to healthy food, including fresh fruits, vegetables, meats and diary products. Millions of Americans — mostly poor, many African-Americans — live in these areas. In fact, the United States Department of Agriculture reports that about 23.5 million Americans currently live in food deserts, including 6.5 million children. Typically, food deserts are defined by: 1) the lack or absence of large grocery stores and supermarkets that sell fresh produce and healthy food options; and 2) low-income populations living on tight budgets. These food deserts are also signified by high levels of obesity, diabetes and cardiovascular diseases in the community, which result from residents buying their food from corner stores that sell processed foods, and plentiful fast food options.

San Francisco has a fairly large food desert located in the Bayview, Hunters Point and Visitacion Valley neighborhoods – some of the poorest in San Francisco. In San Francisco, a staggering 150,000 people, 20% of the city’s population forsakes buying food in order to pay their bills. In Hunters Point, some 40,000 residents travel miles to the nearest grocery store. Most turn to nearby high-fat, high-sodium fast food. “The dollars spent by the fast-food industry far outnumber any resources that we as a city could spend on outreach and education.” San Francisco Supervisor Eric Mar told CNN. “No amount of physical activity can undo the harms of unhealthy eating.” Other Bay Area food deserts include neighborhoods in Oakland and Richmond. And each is not unlike many cities in California. Eighty-five percent of the state's food deserts are found in urban areas.

Police Search for Gunman who Shot Child

The search for whoever shot a five-year-old girl is still going on while people in the neighborhood are demanding changes in and around the liquor store where the girl was hit by a stray bullet. Community organizers say the liquor store is a hub for criminal activity.



Two young men are believed to have fired at each other in front of the Torino Grocery Market on Third Street near Palou Avenue. Both men missed each other, but a stray bullet struck a five-year-old girl in the leg.

Police say they know the identity of one of the shooters and investigators are looking at numerous surveillance footage from around the area. One security tape is said to have shown the actual shooting.

Neighbors told ABC7 they've been warning authorities that crime around the liquor store is getting worse and worse.

One man, who was too scared to be identified, said he event old police he feared a child would be shot someday.

"There are so many children who walk up and down the corner," the man said. "I warned them."
The neighbor, and others, began asking police and the city attorney's office months ago to do something about the store.

"It's a problem," said supervisor Mahlia Cohen. "Our office has heard from many of the neighbors."
Cohen is now asking for a meeting with the owners of the market, saying she wants them to help get rid of the blight.

"We're talking about everything: Loitering, drug sales..." Cohen said. "We're talking about sleeping on the streets. We're talking about intoxication."

The liquor store owners did not want to comment, but former supervisor Sophie Maxwell says the city could close down the store if they don't cooperate.

Years ago, Maxwell introduced legislation that was modeled after Oakland's aggressive and highly successful city ordinance that allows officials to order liquor stores to clean up their act.

"The laws (include) being able to see inside and outside, being able to have light," Maxwell said. "Being able to monitor whether or not they've called the police because people are loitering outside."
Maxwell says city officials and police dropped the ball, and that little was done. But Maxwell says they have a good excuse to begin enforcing the law now that a little girl has been shot.

"I don't know how important it is who dropped the ball," Maxwell said. "The importance now is the ball needs to be picked up."

Oakland passed the ordinance a few years ago that gives city officials the power to hold liquor stores accountable. Today, city officials say they've identified 50 of the 250 liquor stores as potential problems.

Caltrain to close Jerrold Ave for Bridge Replacement


Caltrain is in the process of replacing its 100+ year-old bridge over Jerrold Avenue. They are inching closer to the date to actually roll in the new bridge and roll out the old one. In order to do so, they have to close Jerrold Avenue around the clock beginning October 6, for up to 30 days. The closure will only be between Quint and Rankin streets. Traffic can detour around the closure, primarily by using Oakdale. The closure is required to finish final assembly and move the bridge into place. The replacement will take place over one night, tentatively scheduled for late night Friday, Oct. 14 into early morning Saturday, Oct. 15. Once the new bridge is in place, crews will need to keep the street closed in order to dismantle the old bridge. The street will be open no later than November 5, but the construction crews hope to get it open sooner than that. Also, traffic message signs will be deployed no later than early next week to ensure motorists are informed as well.

Bayview to get healthier at SECF September 24th

The Southeast Community Facility Commission's 4th Annual Family Health Fair is scheduled for Saturday September 24th from 10am to 2pm. As in past years, healthy food, health care advice, children’s gardening activities, and entertainment will be abundant.

New this year is a very special awards presentation. Louise C. Jones and Catherine Sneed, respected for lifetimes of service to the education and wellness of all those living in Bayview Hunters Point, will receive well-deserved recognition for their accomplishments.

The Family Health Fair is a family-oriented event organized by the Southeast Community Facility Commission in partnership with the San Francisco Public Utilities Commission, San Francisco Unified School District, and many businesses, community-based organizations, and concerned citizens from Bayview Hunters Point.

“Obesity, diabetes and asthma can be stopped if our families and community stand together,” stated Commissioner Louise C. Jones, organizing committee chair.

People living in Bayview Hunters Point live on average 14 fewer years than those who live on Russian Hill, according to www.HealthMattersinSF.org.

EVENT: National Public Lands Day

On September 24th, 2011, an estimated 180,000 volunteers around the nation will build trails and bridges, pull invasive weeds, plant trees, remove trash and have fun getting back to nature as part of the 18th National Public Lands Day. At the same time, they’ll get quite a workout on America’s public lands, the gym with a view.

Please join Parks 94124  in conjunction with San Francisco Recreation and Parks Department, the City and County of San Francisco and Habitat for Humanity as we work to clean up local parks in the Bayview Hunter's Point Community. Volunteers from anywhere and everywhere are welcome and most appreciated as we help to do our part for San Francisco’s open lands and parks.

Volunteer Projects include: Park beautification, trash pick up, weeding, mulching, playground sand sifting, edging and clearing.

Participants will work at Bayview Playground, Hilltop Park, Adam Rogers Community Garden, Young Blood Coleman, and Gilman Playground.

We will kick-off the day at Joe Lee Recreation Center - 1395 Mendell Street in San Francisco.

Five year-old girl shot at Third and Palou

Police are at Third and Palou investigating a shooting involving a five year old girl.
This is a developing story - more to come.

A 5-year-old girl was the unintended victim of shooting in San Francisco’s Bayview neighborhood Tuesday afternoon, she has been hospitalized with injuries that are not life-threatening.

The girl, who San Francisco police did not publicly identify, was shot at about 4:30 p.m. Tuesday while walking north on Third Street near Palou Avenue, the same intersection that was the scene of the controversial shooting death of Seattle parolee Kenneth Harding Jr. in July.

UPDATE: 'Self-defense' stabber held on suspicion of murder

An update to yesterday's story from SFGate,
The woman who told San Francisco police that she had fatally stabbed a man after he broke into her Bayview home has been arrested on suspicion of murder, police said today.

Athena Wortham, 42, told police that she heard noises in her apartment on the 700 block of Kirkwood Avenue at about 4:47 a.m. Sunday, and that when she investigated she was confronted by a man who tried to choke her.

Wortham used a knife to stab the man, 40-year-old Anthony Payne of San Francisco, police said.

Investigators are looking into whether Wortham and Payne had a previous relationship, said police spokesman Officer Carlos Manfredi. Although she has been arrested, they are also still looking into whether she was acting in self-defense, he said.

"They're still determining whether or not she was a victim here," Manfredi said.

Court Approves $1.75 Million Settlement of Wrongful Death Suit Against San Francisco Nightclub

Eduardo Mendoza and Denise Mendoza, parents of Justin Mendoza, obtained court approval of the settlement in the wrongful death suit (Case No. CGC-070461540) against Club Cocomo, K-Dubb Security, and the property owners for $1.75 million. Justin Mendoza, 21 years old at the time, was fatally shot on March 21, 2005, on Indiana Street near Club Cocomo after attending a "hip-hop" event.

"Nightclub violence is a serious problem in San Francisco. Police, politicians, citizens, and even the industry-friendly San Francisco Entertainment Commission are beginning to scrutinize, restrict licenses, and even close outfits like Club Cocomo. This precedent-setting settlement should serve as a wake-up call to the clubs that cater to and profit from the violence-prone club-goers without taking any responsibility for the consequences," said David C. Anderson of the Law Office of David C. Anderson, who represented the Mendoza family. "The history of violence not only inside the nightclub but out on Indiana Street should have resulted in its closure years ago. Unfortunately, no action was ever taken and the promising life of Justin was ended. The Mendoza family hopes this settlement will send a loud and clear message that enough is enough and that no family will have to suffer the loss of a loved one due to preventable violence."

Records from the San Francisco Police Department (SFPD) indicated a long history of fighting, stabbings, and use of weapons inside and in front of Club Cocomo, along with nearly 100 complaints of noise disturbances going back to January 1, 2004.

"In addition, two SFPD Bayview District sergeants described the club as one of the 'hot spots' known to law enforcement as a magnet for gangs and others prone to violence, particularly on hip-hop nights," added Anderson.

Bad guys get arrested in threes

SF Examiner: 3 Three arrested in San Francisco for buying stolen copper from undercover cops
Three people were arrested at a recycling center in San Francisco's Dogpatch neighborhood after buying stolen copper and other metals from undercover police officers early Saturday morning, police said Monday.

The sting took place around 6 a.m. Saturday at a recycling center near the intersection of 20th and Indiana streets.

PG&E has documented more than 35 thefts of underground vault utility copper in the past six months, while The City's Department of Public Works has reported numerous stolen manhole covers and backflow preventers, according to police.

SF Examiner: Three arrested in Candlestick parking lot brawl after 49ers game
A vicious parking lot brawl at Candlestick Park that injured three people, including a security guard, led to a trio of arrests and the seizure of a Colt pistol on Sunday, police at Bayview Station said Monday.

San Francisco cops working security at the San Francisco 49ers game found one of the victims bleeding from the head in the parking lot around 5 p.m., shortly after the home team lost to the Dallas Cowboys 27-24 in overtime.

Three suspects were apparently mad at the victim for standing in front of their car and not allowing them to back out, police said. After exchanging words with the victim, the suspects got out of the car and assaulted him.

S.F. woman stabs home intruder to death

A woman fatally stabbed a San Francisco man after he allegedly broke into her Bayview home and tried to choke her, police said today.

The woman, whom police have not identified, heard noises in her home on the 700 block of Kirkwood Avenue at about 4:47 a.m. Sunday and encountered Anthony Payne, 40, who tried to choke her, police said.

She fought back and stabbed him with a knife, killing him, police said.  Investigators have not released any more details on the incident.

The stabbing was one of several violent incidents in the city over the weekend.

Asian American SF Political Clout Grows

...racial identity is still an important factor in the voting choices of ethnic communities, and continuing demographic trends could boost the Asian community's political power in years to come.

In District 10, which includes Bayview-Hunters Point, the Potrero and Visitacion Valley, Asian Americans now are the largest single ethnic group, with better than 38 percent of the population. And District 11, the Excelsior, Oceanview, Ingleside and Outer Mission, now has an Asian majority, with 51 percent of the residents.

Bayview District Weekend Recap


On September 15th between 11:00 PM and 8:30 AM the following morning, a burglary occurred at one of the sheds at Pier 50. This is an open warehouse secured by a roll-up door and chain link fence. The fence was cut and the surveillance cameras were damaged. Officers met with the owner of the warehouse and he could not immediately state what, if any items, had been stolen. This incident is under investigation. (SFPD Case No. 110745564)

On September 15th between 4:00 PM and 6:00 AM the following morning, a commercial establishment on the 1500 block of Burke was burglarized. Officers responded to a call of an alarm at the location and met with the owner. They gained entry and found that the store had been ransacked and that there was a large rock in the middle of the floor that the suspect used to break a window to gain entry. A computer was laying on the ground that had been damaged by its fall in the suspect’s bungled attempt to steal it. Crime Scene Investigations responded to process the scene. This incident is under investigation. (SFPD Case No. 110745354)
